we will provide our services to you

Big Tree Gardeners is a trading name of BT Gardeners Limited, company number 15651839, hereinafter referred to as the Company. These terms set out the basis on which the Company provideds its services and govern use of the Company’s website.

TERMS OF BUSINESS

These terms apply to all garden maintenance services provided by the Company. They explain how services are delivered, what you can expect from the Company, and what is required from you.

1Definitions

In these terms:

“The Company” means Big Tree Gardeners, being the trading name of BT Gardeners Limited, and anyone authorised by the Company to carry out work.

“You” means the individual or organisation engaging the Company.

“The Operative” means the person sent by the Company to carry out the work.

“The Goods” means any materials supplied by the Company.

“The Services” means the garden maintenance services agreed to be provided by the Company.

2General Maintenance Services

The Company provides proactive and tailored garden maintenance services.

Initial Assessment and Scheduling: An initial visit may be carried out to assess maintenance requirements. Based on that assessment, a maintenance schedule may be proposed. Recommendations for improvements or enhancements may also be provided.

Maintenance Tasks: General maintenance may include, but is not limited to, lawn care, lawn mowing, weeding, pruning, planting, hedge trimming, mulching and jet washing.

Green waste Disposal: Where possible, existing green waste recycling facilities such as green bins will be used. If removal of all garden waste is requested, this may be provided at a charge of £30.00 plus VAT per bag, regardless of how full the bag is.

3Pricing & Payment Terms

Quotation: The cost of services will be set out in a quotation provided to you. The standard rate is £32.50 plus VAT per hour, per gardener, unless otherwise agreed.

Minimum Hours: A minimum charge of 2 hours applies to any visit.

Additional Work: If additional work is required due to restricted access, unavailable utilities or unforeseen issues, an additional reasonable charge may apply.

Billing Details: Invoices will show quoted rates, materials supplied and any additional expenses.

Billing Cycle: Invoices are issued monthly, typically around the 15th of each month, covering services provided in the previous month.

Payment Due Date: Payment is due in full on the invoice date. The Company reserves the right to allow a short administrative grace period at its discretion.

Payment Methods: Payment may be made by bank transfer or Direct Debit.

Late Payment Fees: A late payment fee of £25 plus VAT may be applied to invoices unpaid 28 days after the due date.

Non-Payment: The Company reserves the right to suspend services for overdue accounts and may apply payments to the oldest outstanding balance first.

Price Adjustments: Prices may be adjusted where unforeseen factors affect the cost of the job. Any changes will be communicated as soon as reasonably possible.

4Cancellation Policy

There are no fixed or long-term contracts.

To cancel a scheduled visit without charge, at least 48 hours’ notice must be provided.

Cancellations made within 48 hours of the scheduled visit may incur a cancellation fee of £65 plus VAT.

5Your Responsibilities As A Customer

To ensure services are delivered safely and efficiently, you agree to the following:

Access: Access to the garden must be provided during working hours, 7:30am to 5:00pm, Monday to Friday.

Neighbouring Properties: Where access is required via neighbouring land, permission must be obtained in advance.

Parking: Suitable parking must be provided. Any parking fees or permits required will be charged to you where applicable.

Hazards: You must notify the Company of any known hazards.

Preparation and Utilities: Work areas must be clear and accessible. Electricity and water must be available where required.

Pet Waste: Gardens must be cleared of pet waste prior to visits.

Ground Conditions: You are responsible for ensuring ground conditions are safe. The Company is not liable for damage caused by stones or debris ejected by equipment.

Safety of Others: Children and pets must be kept clear of work areas while power tools are in use. Responsibility rests with the property owner or occupier.

6Other Conditions

Materials: Special materials required will be charged.

Jet Washing: No liability is accepted for damage to surfaces with pre-existing defects.

Scheduling: The Company is not responsible for delays caused by circumstances outside its reasonable control.

Liability: The Company is not liable for accidental or unforeseeable losses arising during works.

Consumer Rights: Nothing in these terms affects statutory consumer rights.

Force Majeure: The Company is not liable for delays or failures caused by events beyond reasonable control, including extreme weather, strikes or natural disasters.

1Introduction

These terms govern your use of the Company’s website. By accessing or using the website, you agree to be bound by these terms in full.

If you do not agree with these terms or any part of them, you must not use the website.

Where registration is required, you will be asked to expressly confirm acceptance of these terms as part of the registration process.

The website is intended for use by individuals aged 18 years or over. By using the website, you confirm that you meet this requirement.

The Company reserves the right to revoke any licence granted under this section at any time, with or without notice or explanation.

3Acceptable Use

The website must not be used in any way that causes, or may cause, damage to the website or impairment of its availability or accessibility, or in any way that is unlawful, illegal, fraudulent or harmful.

You must not use the website to copy, store, host, transmit, send, use, publish or distribute any material that consists of, or is linked to, spyware, computer viruses, Trojan horses, worms, keystroke loggers, rootkits or any other malicious software.

You must not conduct any systematic or automated data collection activities on or in relation to the website without the Company’s express written consent. This includes, without limitation, scraping, data mining, data extraction and data harvesting.

4Restricted Access

Access to certain areas of the website may be restricted. The Company reserves the right to restrict access to other areas of the website, or the entire website, at its discretion.

Where a user ID and password are provided to enable access to restricted areas, those credentials must be kept confidential.

You must notify the Company immediately in writing if you become aware of any unauthorised use of your account or password.

You are responsible for all activity carried out under your login details. The Company may suspend or disable any user ID or password at its discretion, without notice or explanation.

5User Generated Content

In these terms, “user generated content” means any material submitted to the website, including text, images, audio, video or audio-visual material.

You grant the Company a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate and distribute user generated content in any existing or future media. This licence includes the right to sub-license such rights and to bring an action for infringement.

You warrant that any user generated content complies with these terms and is lawful, accurate and does not infringe the rights of any third party.

User generated content must not be illegal, defamatory, obscene, offensive, misleading, discriminatory, threatening or otherwise objectionable, nor give rise to legal action against you, the Company or any third party.

The Company reserves the right to edit or remove any user generated content submitted to the website. The Company is not obliged to monitor user generated content.

6Limited Warranties

The website and its content are provided on an “as is” and “as available” basis.

The Company does not warrant the completeness, accuracy or reliability of any information published on the website, nor does it warrant that the website will always be available or free from errors.

To the maximum extent permitted by applicable law, all representations, warranties and conditions relating to the website and its use are excluded.

7Limitations & Exclusions Of Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

Subject to the above, the Company is not liable for any loss or damage arising out of or in connection with use of the website, including indirect or consequential loss, loss of profit, loss of business, loss of data or loss of goodwill.

Liability is excluded to the fullest extent permitted by law, including any implied warranties or conditions.

8Indemnity

You agree to indemnify and keep indemnified the Company against all losses, damages, costs, liabilities and expenses (including legal costs) incurred or suffered by the Company arising out of any breach by you of these terms or any claim that you have breached these terms.

Without prejudice to the Company’s other rights, where you breach these terms or where the Company reasonably suspects such a breach, the Company may take such action as it considers appropriate, including:

(a) issuing warnings;

(b) suspending or terminating access to the website;

(c) blocking access from specific IP addresses;

(d) removing or editing user generated content;

(e) commencing legal proceedings; and

(f) disclosing information to law enforcement authorities where reasonably necessary.

The website may include links to third party websites. These links are provided for convenience only and do not constitute endorsement.

The Company has no control over the content of third-party websites and accepts no responsibility or liability for them or for any loss or damage arising from their use.

12Assignment

The Company may assign, transfer, sub-contract or otherwise deal with its rights and obligations under these terms without notice or consent.

You may not assign, transfer or otherwise deal with your rights or obligations under these terms.

If any provision of these terms is held to be unlawful or unenforceable, the remaining provisions remain in full force and effect.

Where part of a provision is unlawful or unenforceable, that part shall be deemed deleted while the remainder continues to apply.

14Exclusion Of Third-Party Rights

These terms are for the benefit of you and the Company only.

No third party has any right to enforce any provision of these terms under the Contracts (Rights of Third Parties) Act 1999.

15Entire Agreement

These terms, together with the Company’s privacy policy, constitute the entire agreement between you and the Company relating to your use of the website and supersede all previous agreements or understandings.

16Domian Registration & Copyright Owner

AB1 Group Limited is the owner of the Big Tree Gardeners brand and the registered domain owner of bigtreegardeners.uk.

Unless otherwise stated, all intellectual property rights in the website and its content, including text, graphics, logos, images and software, are owned by AB1 Group Limited or its licensors and are protected under English and international copyright laws.

AB1 Group Limited grants BT Gardeners Limited, trading as Big Tree Gardeners, a licence to use the Big Tree Gardeners name, brand and domain and to operate the bigtreegardeners.uk website.

17Law & Jurisdiction

These terms are governed by English law, and disputes are subject to the non-exclusive jurisdiction of the courts of England and Wales.
